W książce zawarto wyniki badań nad zagadnieniem praktycznego wykorzystania przez organy wymiaru sprawiedliwości możliwości racjonalnego ukarania sprawcy przestępstwa bez uciekania się do jego uwięzienia oraz przedstawiono wynikające z tych badań wnioski. Siedmioosobowy zespół autorski tworzą pracownicy naukowi Zakładu Prawa Karnego Instytutu Nauk Prawnych Polskiej Akademii Nauk.Item Błąd co do prawa w prawie karnym skarbowym(2022) Nogal, AndrzejThis doctoral dissertation presents the problem of a legal error in Polish criminal fiscal law. The obligation of general knowledge of the law is recognized as a binding principle in Polish criminal law. However, in some cases it is possible to invoke a legal error where the error in law was excused. This applies in particular to fiscal penal law, which penalizes violations of the standards of broadly understood economic law and thus creates a non-intuitive catalog of prohibited acts. The legal nature and function of the institution of a legal error in fiscal penal law have long aroused controversy in the doctrine and jurisprudence. The aim of the study was to prove the thesis that the right to make an excused error as to the law should be regarded as one of the principles of criminal law, anchored in the Polish Constitution. The regulation of a legal error in the fiscal penal code fulfills the function of defining the limits of the application of the ignorantia iuris nocet legal principle. The theoretical and practical aspects were taken into account in the work. This work consists of an introduction, five substantive chapters, ending, bibliography and a list used in the work of judicial decisions. Each chapter includes introductory notes and a summary. The structure of the dissertation work results from the research questions and research methods used in the work. The first chapter is entitled "Error in law in the perspective of historical influence on Polish legal notion”. It contains a comprehensive description and genesis of error in law in the historical space. The author also points to the importance of the chain of connections between individual legal systems and their impact on contemporary Polish legislation. The second chapter describes the circumstances justifying the lack of awareness of a criminal record, based on literature and judicature. It presents both the classic circumstances justifying the ignorance of unlawfulness, and the new ones, which are a product of modern judicial practice, which have not been subject to comprehensive theoretical studies yet. The third chapter of the work is devoted to the empirical verification of theoretical models with the use of judicial decisions. Also described, specific to the fiscal criminal law, the perpetrator's illegal activity on the basis of a tax interpretation and the criminal law consequences of an unjustified error in law were also described. Chapter four focuses on the construction of legal error. This chapter also presents the issues related to the definition of error from various perspectives. The issues related to the distinction between a legal error and similar institutions were also presented. This chapter also discusses theories justifying error in law, the classification of such, or the issue of error in law in unintentional offenses. The last chapter of the work discusses the essence and function of error as to the law. For this purpose, it was necessary to refer to such fundamental problems of fiscal penal law as illegality, punishability or social harmfulness. statutory changes. This work demonstrates the constant, practical, topicality of the institution of error as to the law. In this situation, this work will serve not only the development of legal science, but also provide guidance to judicial decisions.Item Compliance i inne mechanizmy zapobiegania korupcji(INP PAN, 2024) Nowak, Celina; Lizak, RobertKorupcja towarzyszy człowiekowi od dawna, ale, jak z chorobą toczącą społeczeństwo, lepiej jej zapobiegać niż leczyć. Mechanizmem pozwalającym skutecznie zapobiegać korupcji są programy compliance. W kontekście prawnym pojęcie compliance odnosi się do procesu tworzenia, przyjmowania i obowiązywania norm (zasad i procedur) w ramach organizacji, które zapewniają zgodność jej działalności z przepisami prawa. W książce zaprezentowano teoretyczne ujęcie zjawiska compliance jako nowego poziomu regulacyjnego, a także modelowe rozwiązania praktyczne odnoszące się do compliance, oparte na amerykańskim modelu programu compliance. Analizie poddano także dwa inne mechanizmy zapobiegania korupcji, to jest system ochrony osób zgłaszających naruszenia (sygnalistów) oraz rejestry korzyści.Item Ochrona interesów finansowych Unii Europejskiej w świetle polskiego prawa karnego(INP PAN, 2023-07-14) Nowak, CelinaOchrona interesów finansowych UE stanowi na podstawie art. 325 ust. 1 Traktatu o funkcjonowaniu Unii Europejskiej wspólne zadanie Unii i państw członkowskich, przy czym państwa członkowskie są zobowiązane do podejmowania takich samych środków do zwalczania nadużyć finansowych naruszających interesy finansowe Unii, jakie podejmują do zwalczania nadużyć finansowych naruszających ich własne interesy finansowe. Zobowiązanie państw członkowskich UE ma, po pierwsze wymiar legislacyjny – państwa członkowskie UE są bowiem zobligowane do dostosowania swoich ustawodawstw do wiążących unijnych aktów prawnych; po drugie – wymiar instytucjonalny – państwa członkowskie mają powołać u siebie instytucje i organy chroniące interesy finansowe Unii oraz współpracujące z partnerami z innych krajów oraz z UE; i po trzecie – wymiar praktyczny, który polega na skutecznej realizacji tego zobowiązania. Wobec zakończenia procesu zmian instytucjonalnych i prawnych na poziomie unijnym, obecnie państwa członkowskie UE muszą dostosować swoje prawo do nowych unormowań oraz podjąć współpracę ze zreformowanymi lub całkiem nowymi instytucjami. Pracę poświęcono analizie wypełnienia przez Polskę zobowiązania ochrony interesów finansowych UE we wskazanych trzech płaszczyznach, w oparciu o pogłębione badania ustawodawstwa oraz rozwiązań instytucjonalnych i praktyki stosowania przepisów. Celem rozważań jest zbadanie, na ile skutecznie w Polsce chronione są obecnie interesy finansowe UE za pomocą instrumentów z zakresu prawa karnego oraz odpowiedzialności podmiotów zbiorowych za czyny zabronione pod groźbą kary. Zgodność polskiego prawa i praktyki z wymogami płynącymi z dyrektywy PIF oraz ogólnie z prawem UE w zakresie ochrony unijnych interesów finansowych zyskała na znaczeniu pod koniec 2020 r. wraz z wejściem w życie przepisów o ogólnym systemie warunkowości służącym ochronie budżetu UE. Jednym z kluczowych elementów tego systemu jest sprawna i skuteczna ochrona interesów finansowych UE. Brak skutecznej ochrony może bowiem przełożyć się na konkretne decyzje o wstrzymaniu środków dla Polski. Z tego względu w interesie państwa polskiego jest doprowadzenie do zgodności z omawianymi w monografii unormowaniami prawa UE oraz poprawa sytuacji w zakresie praktycznych aspektów ścigania czynów godzących w interesy finansowe Unii. Podsumowując rozważania przeprowadzone w tej pracy, należy stwierdzić, że Polska zadania ochrony interesów finansowych UE za pomocą środków prawnokarnych nie realizuje w sposób, który można by uznać za zadowalający. Brak harmonizacji przepisów co do kryminalizacji, na czele z luką co do kryminalizacji niewłaściwego wykorzystania uzyskanych legalnie środków unijnych, zupełna niewydolność systemu odpowiedzialności podmiotów zbiorowych, brak refleksji nad systemem kar i środków karnych w prawie karnym powszechnym i skarbowym to podstawowe powody skłaniające do uznania polskich unormowań materialnoprawnych za niewystarczające. Decyzja o nieprzystąpieniu do wzmocnionej współpracy w zakresie ustanowienia Prokuratury Europejskiej osłabia arsenał środków w dyspozycji polskich prokuratorów w ramach postępowań w sprawach o czyny godzące w interesy finansowe Unii Europejskiej. Jeśli chodzi o praktyczne aspekty ochrony interesów finansowych UE w Polsce, ustalono, że rozmiary przestępczości na szkodę interesów finansowych UE w Polsce są niewielkie. W sprawach tych toczy się zaledwie kilkaset postępowań przygotowawczych rocznie, przy czym co najmniej połowa z nich jest umarzana z powodu braku znamion przestępstwa. Wartość zabezpieczanego mienia rośnie. Dostępne dane odnoszą się tylko do postępowań przygotowawczych – w Polsce nie istnieje system zbierania danych na temat tej grupy przestępstw. The protection of the financial interests of the European Union is a shared responsibility of the Union and the Member States under Article 325(1) of the Treaty on the functioning of the European Union, with Member States being obliged to take the same measures to counter fraud affecting the Union’s financial interests as they take to counter fraud affecting their own financial interests. The commitment of the EU Member States has various dimensions: legislative, as EU Member States are obliged to align their legislation with binding EU acts; institutional, as Member States are to set up domestic institutions and bodies to protect the financial interests of the Union and to cooperate with partners from other countries and the EU; and practical, which consists in the effective implementation of this commitment. With the completion of institutional and legal changes at the EU level, it is now up to the EU Member States to adapt their laws to the new regulations and to cooperate with the reformed or completely new institutions. The book at hand analyses Poland’s fulfilment of its obligation to protect the EU’s financial interests at the three levels identified above, based on an in-depth study of legislation, institutional arrangements and practice. The purpose is to examine how effectively EU financial interests are currently protected in Poland through criminal law instruments and the liability of collective entities for criminal offences. The compliance of Polish law and practice with the requirements stemming from the PIF Directive of 2017 and general EU law regarding the protection of EU financial interests has gained importance since the provisions on the general conditionality regime of protecting the EU budget came into force at the end of 2020. One of the key elements of this system is the efficient and effective protection of the EU’s financial interests. Indeed, a lack of effective protection may translate into concrete decisions to withhold funds for Poland. Therefore, it is in the interest of the Polish state to bring about compliance with the norms of EU law discussed in this book and to improve the situation with regard to the practical aspects of prosecuting acts detrimental to the financial interests of the Union. In summarising the considerations in this book, it should be stated that Poland does not fulfil the task of protecting the EU’s financial interests by means of criminal law measures in a manner that could be considered satisfactory. The lack of harmonised provisions as regards criminalisation – first and foremost the gap in criminalisation of misuse of legally obtained EU funds – the complete inefficiency of the system of liability of collective entities and the lack of reflection on the system of penalties and criminal measures in the general criminal law and fiscal law are the basic reasons for considering the Polish substantive legal norms insufficient. Additionally, the decision not to join the enhanced cooperation that the European Public Prosecutor’s Office represents weakens the arsenal of means at the disposal of Polish prosecutors in proceedings for acts detrimental to the financial interests of the EU. As regards the practical aspects of protecting the EU’s financial interests in Poland, it is established that the extent of crime against the EU’s financial interests in Poland is small. There are only a few hundred pre-trial proceedings per year in these cases, at least half of which are discontinued due to the lack of criminality. The value of the property secured is increasing. On the other hand, in Poland there is no system for collecting data on this group of crimes, and the available data refers only to preparatory proceedings.
