Autor analizuje instytucję decyzji zobowiązującej. Przedstawia najważniejsze decyzje zobowiązujące wydane dotychczas przez Prezesa Urzędu Ochrony Konkurencji i Konsumentów oraz dokonuje ich analizy z punktu widzenia poprawności proceduralnej i zgodności z prowadzeniem optymalnej polityki prawa konkurencji. Proponuje odpowiednie rozwiązania występujących obecnie problemów proceduralnych i systemowych oraz stawia tezę, że problemy o charakterze systemowym są wpisane w charakter instytucji decyzji zobowiązujących.
The author begins with the analysis of the commitment decisions institution in the Polish competition law. Then, the most important commitment decisions issued by the President of the Office of Competition and Consumer Protection are presented and analysed. The essence is to propose appropriate solutions for both procedural and systemic problems and to put forward the thesis that the systemic problems are inscribed in the nature of this institution.
